Abstract

Forest degradation in Sumatra due to illegal logging has reached a critical stage, not only destroying biodiversity but also triggering hydrological disasters such as flash floods, landslides, and water crises. This study aims to analyze the limitations of enforcing positive law in addressing this issue and explore the potential of integrating Maqashid Sharia values as a complementary approach to build social compliance. The method used is library research with a descriptive-analytical approach, examining Law No. 18 of 2013 in conjunction with the Job Creation Law, ecological literature, and the concept of Maqashid Sharia. The findings indicate that a purely coercive legal approach has fundamental weaknesses, such as limited enforcement capacity, corruption, and implementation gaps at the ground level. On the other hand, the universal principles of Maqashid Sharia particularly the protection of life (hifzh an-nafs), property (hifzh al-mal), and the prohibition of corruption (fasad fil ardh) offer an ethical foundation for environmental conservation that aligns with the objectives of state forestry law. This normative convergence forms the basis for formulating a synergistic model involving value harmonization, institutional collaboration (government, religious leaders, indigenous communities), mosque/pesantren-based ecological education, and law enforcement reinforced by collective moral pressure. The study concludes that integrating religious values is not meant to replace state law but to root legal compliance through value internalization and strengthened social control. This synergy model is expected to enhance the effectiveness of hydrological disaster mitigation by fostering voluntary and sustainable compliance, thereby positioning forest conservation not merely as a legal obligation but also as a moral and religious responsibility.
