TINJAUAN PUTUSAN HAKIM TERHADAP CERAI GUGAT AKIBAT MURTAD DI PENGADILAN AGAMA METRO
Abstract
This study aims to carefully analyze the judge’s decision in a divorce case filed due to apostasy and how the judge’s considera tions at the metro Religious court in deciding the divorce case filed due to apostasy. The researcher used a qualitative research method of the juri dical-sociological type with a case study focusing on considera tions of the metro Religious Court judge in deciding the divorce case filed due to the hu sb and’s apostasy. This research is import ant because it c an provide knowledge to the community rega rding the mari tal status if one of the partners apostatizes. The results of this study indicate tha t the metro Religious Court judge gra nted the plaintiff’s lawsuit and declared ( annulled) the marri age between the plaintiff and the defend ant because the defend ant apostatized.
