PRODEO SEBAGAI AKSES KEADILAN BAGI MASYARAKAT MISKIN DI PENGADILAN AGAMA TANJUNG KARANG KELAS 1 A
Abstract
Access to justice is a fu ndame ntal right gua ranteed by the co nstitutio n, yet poo r commu nities i n I ndo nesia still face ba r rie rs such as case fees, limited legal se rvices, a nd low legal lite racy. This study aims to evaluate the impleme ntatio n of the p rodeo mecha nism as a mea ns of fee waive r i n the Religious Cou rt of Ta nju ng Ka ra ng Class 1A. A field resea rch app roach was applied, combi ni ng no rmative-ju ridical a nd empi rical pe rspectives, suppo rted by compa rative study a nd evaluative a nalysis. The fi ndi ngs reveal that although the p rodeo system has a st ro ng legal fou ndatio n a nd fo rmal p rocedu res, its utilizatio n remai ns low. Majo r obstacles i nclude budget a nd case quota limitatio ns, lac k of socializatio n, low legal awa re ness, social stigma, a nd complex admi nist rative requi reme nts. Co nve rsely, regulato ry suppo rt, judicial commitme nt, a nd collabo ratio n with legal aid i nstitutio ns se rve as suppo rti ng facto rs. I n te rms of quality, p rodeo se rvices a re equivale nt to paid cases, although case resolutio n te nds to be slowe r a nd commu nicatio n with applica nts remai ns suboptimal. This study co ncludes that p rodeo has the pote ntial to fu nctio n as a n i nclusive justice i nst rume nt, but refo rms i n p rocedu re, e nha nced socializatio n, legal educatio n, a nd st re ngthe ned huma n resou rce capacity a nd budget a re needed to ma ke it mo re respo nsive to the needs of the poo r.
